Sports Arbitration Cases and their Practical Compliance with the Code Essay

Sports Arbitration Cases and their Practical Compliance with the Code of Ethics for Arbitrators in Commercial Disputes - Essay Example One noticeable and waiting case was of the Major League Baseball's (MLB) and the Major League Umpires Association in 1999 parleyed by Alan Symonette, picked by the two gatherings. The case, recorded in 1999 with real got notification from December 13 to August 29, 2000 removed a long time for the working from legitimate papers as Symonette composed his 100-page choice. The two gatherings communicated positive and negative responses with Symonette's choice indicating unprejudiced nature on his part and adherence to the standards of the code with Canon I unequivocally expressing An Arbitrator ought to maintain the respectability and reasonableness of the intervention procedure. Symonette demonstrated his obligation to both the MLB and the umpires by having their requirements and debates meet most of the way as nine umpires were recruited back comprehensive of back pays while the 13 different umpires who were excused stayed as they were. Under Canon I, area F expressing An authority should direct the mediation procedure in order to propel the reasonable and productive goals of the issues submitted for choice. A mediator should put forth all sensible attempts to forestall postponing strategies, badgering of gatherings or different members, or other maltreatment or interruption of the intervention procedure, just as Canon IV's An Arbitrator Should Conduct the Proceedings Fairly and Diligently under segment E, When the Arbitrator confirms that more data than hosts been introduced by the gatherings is required to choose the case, it isn't ill-advised for the authority to pose inquiries, call observers, and solicitation records or other proof, including master declaration, Symonette have indicated cautious thought in spite of the waiting of the case (AP, 2005). NBA Teams versus Player/s Another case of a National Basketball Association (NBA) assertion case is that of Nate Huffman and the Toronto Raptors refereed by Roger Kaplan mutually affirmed by the two gatherings. The case including the end of a three-year agreement of Huffman after just a half year had the group battle that Huffman didn't completely unveil his clinical history of his knee issues before marking the agreement. With a ramifications that Huffman informed the administration about his knee issues, Kaplan have demonstrated cautious pondering and adherence to Canon I's segment E arrangement that When a referee's position is gotten from the understanding of the gatherings, a mediator should neither surpass that authority nor do not exactly than is required to practice that authority totally. Where the understanding of the gatherings presents systems to be followed in directing the discretion or alludes to rules to be followed, it is the commitment of the judge to conform to such methods or rules. An authority has no moral commitment to consent to any understanding, methods or decides that are unlawful or that, in the referee's judgment would be conflicting with this Code. By alluding to the agreement marked by the Toronto Raptors and Huffman, Kaplan consented to the understanding of the gatherings in directing the intervention procedure. The Raptors indicated muddled message by guaranteeing Huffman didn't f

How to Write Outstanding College Level Book Reports

How to Write Outstanding College Level Book Reports Theres nothing quite like enjoying a really solid piece of literature. Hours can pass while youre diving into a new world that the author has created. Your enjoyment of your novel may dissipate slightly when you are trying to figure out how to write a college level book report about itâ€"but it doesnt have to be that way. Analyzing (and maybe even critiquing) novels is a useful skill that will help you both in and outside of the classroom. In this post we will outline the best strategies of painlessly writing a book report. Its important to note that there is no one generic book report assignment. This isnt necessarily a step-by-step guide, but it can help get you started thinking about the specific requirements that your instructor has for you.Know the assignmentWhen you start out your book report assignment, its important that you know exactly what your instructor is requiring. Does your instructor want you to explore the books theme and write a five-paragraph essay on it, or are y ou supposed to be writing an essay about a particular character? Read through the assignment sheet very carefully and make sure that you understand all of the instructions. If you have questions or are uncertain about something, be sure to ask your instructor.Actually read the bookEven though it may be tempting to take a shortcut and watch a movie adaptation of your book or even to read the Sparknotes, definitely resist that urge. Not only will your report be more thorough if you read the book the whole way through, but reading and understanding themes and outlining a novel plot is an invaluable experience. Youll be able to understand books on a completely new and more appreciative level. When you are reading the novel for your book report, write down page numbers or passages that pertain to the assignment or that you think might be interesting to mention.Try to really sink into what the author is trying to say by asking yourself the following questions:What is the main theme of the book? The theme is the meaning or the entire reason behind writing the book. An author doesnt typically write just to write something down. What motivated them to pen this novel? What is happening to the characters? Typically novels are told from the perspective (either in the first or third person) of the main character, though some novels have multiple perspectives. Is this character a good character or are they flawed? What kinds of obstacles is the character going through? What did they learn during the course of the story? What is the plot of the book? There are several different kinds of plots, and its helpful to know what kind your chosen novel has in order to help you analyze it better. Some stories are quests: that is, the main character is on a journey to accomplish a goal (think Lord of the Rings). Some stories are overcoming obstaclesâ€"whether thats internal or external. What kind of plot does your novel have and why do you think the author chose that particular type?Wri te a good introductionAfter youve read your book thoroughly and youve thought about the characters, themes, plot, and some good quotes, youll be ready to start writing the book report. Like any other paper, a good book report needs an explanatory introduction that is easy to understand. When writing the introduction, be sure to include the title of the work, the author, and a sentence or two on what you will be overviewing in the report. Even though it may not be required to have a thesis statement in your book report, writing one in your paper might keep it more focused and help you narrow down what you will be writing in the body paragraphs. For example, if we were writing an introduction about a book report over Harper Lees To Kill a Mockingbird, we might write something like this:In Harper Lees iconic coming of age novel, To Kill a Mockingbird, Lee confronts the audience with the idea that systemic racism was rampant in the U.S. court system in the early 20th century in the South . She illustrates this idea with the unfair trial of convicted rapist Tom Robinson, whose lawyer Atticus Finch handily proves is innocent, yet is still sentenced with a crime he did not commit. Through the eyes of the young main character, Scout Finch, the audience is able to learn about these injustices with the innocent eyes of a child. As you can see, we mentioned the name of the book, the author, and we also outlined what we would be discussing throughout the body paragraphs in the book report. Not only will this let the reader know what this report is about, but itll also help you stay organized when you are writing the paper. Note that nowhere in this paragraph does it say that we really liked the book. Whether or not we liked the book is irrelevant in the report. What the book report is trying to do is to objectively understand a books relevance and importance wit themes, characters, motifs, etc. (Though of course its perfectly okay and encouraged to like the book that you are reviewing.)Implement the ideas in the body paragraphsThe meat of your book report will be in the body paragraphs. These paragraphs will expand on the ideas that you brought up in your introduction paragraph and allow you to introduce the novel in depth to your reader.SummaryThough no two book report assignments are the same, its likely that your instructor is going to want to see some summarization in your book report. Your summary of the novel shouldnt be too lengthy (this is a report after all, so its typically quite short). If your instructor has assigned a five-page book report, dont summarize the book in four and a half pages. As a general rule, commit about 1/3 of the paper to a summary just so you can make sure the reader understands your analysis of it without having read it.AnalysisOnce you are done writing the summary of the novel, then you can get into your actual analysis of it. You may remember that we brought up systemic racism in the U.S. court system in the South in our essay on To Kill a Mockingbird. In our summary, we would then explore those ideas that we brought forth to the reader. How does Lee illustrate this idea throughout the novel? A good way to show how the author is making this point is through direct quotations from the book that you believe are a good showcase. In your analysis, you should also be discussing theme (or what was the authors purpose behind writing this book) and character. No two analyses are the same, which is what makes book reports and literary criticism so interesting. Everyone will read the novel through their own personal lenses and experiences and come up with a completely different interpretation of what the author intended for us to come away with.Again, its crucial to keep looking at your instructions for your book report so that you know exactly what you need to be discussing. Even if you write a brilliant report over the theme of systemic racism in the court system in To Kill a Mockingbird, it wont do you any good when you were actually supposed to write about the relationship between Scout and Atticus Finch and why it mattered. Paying attention to instructions is one of the biggest keys to success in writing a book report.ConclusionAs with all other conclusions, focus on wrapping things up neatly. Though you may be tempted to just say in the conclusion that you either loved or hated the book, this doesnt make for a very interesting paragraph. When you are writing your conclusion on your book report, think about why this novel matters. If you didnt like it, think about why you didnt like it. Think about how well the author gets his or her point across. Should this book be read widely to gain a critical understanding of a subject? Why or why not? Would you recommend this book to others? The genre of book reports generally seeks out the opinion of the writer, so make sure that you let your voice be heard.RevisingLike any other paper that you write, its crucial to go back through and r evise if you are turning in the final copy. Its extremely rare that youll write something that doesnt have any mistakes or reworking to do. Once you have written the first draft, take a short break to get your eyes off the paper for just a bit. Come back to the paper after the break with a set of fresh eyes and try to read through it for grammar and spelling mistakes (spell check doesnt get everything!) and then once again for content. Make sure that everything makes sense and is very explanatory. After allâ€"you have to assume that your audience hasnt read your book yet so you want to make sure that you are explaining it well enough to someone who has never read a sentence of it and still be able to understand. If you are uncertain about sentences or even entire passages of your book report, ask a friend or your instructor to take a look at your work. Sometimes it helps to get an outside opinion since youve been closely working with the text.Book reports teach us more than just how to write a reportThough we do a lot of research and studying about subjects that may not be applicable after college, book reports may be one of the only exceptions to that. Novels, no matter how abstract the concept, teach us about human behavior and life through plots and characters. Understanding how to break down an authors intent on their stories will absolutely be relevant to your life. Having the curiosity and the skills to understand a novel with a more complex understanding will undoubtedly enrich your reading experience.Remember than an effective book report will have an introduction that mentions the book title, author, and include the points you will be making throughout the body paragraphs. Your body paragraphs will expand on those ideas that you brought up in the introduction, using quotes from the book, analysis, and summary to aide you. Finally, be sure that once the book report has been written that you are carefully looking at spelling, grammar, and the content of y our paragraphs. Get a friend, your instructor, or even a professional editor to look at your book report to make sure you are on the right track.

Banded Sea Krait Facts (Laticauda colubrina)

The banded sea krait is a type of venomous sea snake found in the tropical water of the Indo-Pacific Ocean. Although this snakes venom is ten times more potent than that of a rattlesnake, the animal is nonaggressive and only known to bite in self defense. The most common name for the species is the banded sea krait, but its also called the yellow-lipped sea krait. The scientific name Laticauda colubrina gives rise to another common name: colubrine sea krait. While the animal may be called the banded sea snake, its better to call it a krait to avoid confusion with true sea snakes. Fast Facts: Banded Sea Krait Scientific Name: Laticauda colubrinaCommon Names: Banded sea krait, yellow-lipped sea krait, colubrine sea kraitBasic Animal Group: ReptileSize: 34 inches (male); 56 inches (female)Weight: 1.3-4.0 poundsLifespan: Unknown. Most snakes can reach 20 years of age under ideal conditions.Diet: CarnivoreHabitat: Indo-Pacific regionPopulation: Stable, probably numbering in the thousandsConservation Status: Least Concern Description A banded sea krait can be distinguished from other krait species by its yellow snout and from true sea snakes by its flattened body and nostril position. Sirachai Arunrugstichai / Getty Images The banded sea snake has a black head and black-striped body. Its upper surface is blue-gray, with a yellow belly. This snake can be distinguished from related kraits by its yellow upper lip and snout. Like other kraits, it has a flattened body, paddle-shaped tail, and nostrils on the sides of its snout. In contrast, an aquatic sea snake has a paddle tail, but a rounded body and nostrils near the top of its head. Banded sea krait females are substantially larger than males. Females average 142 cm (56 in) in length, while males average 87 cm (34 in) in length. On average, an adult male weighs about 1.3 pounds, while a female weighs around 4 pounds. Habitat and Distribution Banded sea krait (Laticauda colubrina) distribution. Sn1per Banded sea kraits are semiaquatic snakes found in shallow coastal waters of the eastern Indian Ocean and western Pacific Ocean. While juvenile snakes spend most of their time in the water, adult kraits spend about half their time on land. The snakes hunt in water, but must return to digest their food, shed their skin, and reproduce. Banded sea kraits exhibit philopatry, which means they always return to their home islands. Diet and Behavior The head and tail of the banded sea krait look similar, which helps deter potential predators. Placebo365 / Getty Images Banded sea kraits are perfectly adapted to hunt eels, supplementing their diet with small fish and crabs. The snake has never been observed feeding on land. The kraits slender body helps it weave through corals. The snakes tail may be exposed, but the threat from predators is reduced because the tail looks much like the head. Banded sea kraits are solitary nocturnal hunters, but they travel with hunting parties of yellow goatfish and bluefin trevally, which capture prey fleeing from the snake. Banded sea kraits display sexual dimorphism in hunting behavior. Males tend to hunt moray eels in shallow water, while females hunt conger eels in deeper water. Males tend to make multiple kills on a hunt, while females typically only take one prey per hunt. Most animals leave sea kraits alone, but they are preyed upon by sharks and other large fish and sea birds when the snakes surface. In some countries, people catch the snakes to eat them. Venomous Bite Because they spend so much time on land and are attracted to lights, encounters between kraits and humans are common but surprisingly uneventful. Banded sea kraits are highly venomous, but only bite in self-defense if grabbed. In New Caledonia, the snakes have the common name  tricot rayà ©Ã‚  (stripey  sweater) and are considered safe enough to play with children. Bites most often occur when fishermen try to untangle the snakes from fishing nets. The venom contains a powerful neurotoxin that can cause hypertension, cyanosis, paralysis, and potentially death if left untreated. Reproduction and Offspring Banded sea kraits are oviparous; they return to land to mate and lay eggs. Mating occurs in September through December. Males chase the larger, slower females and entwine around her. The males rhythmically contract to produce what are called caudocephalic waves. Copulations takes about two hours, but the mass of snakes may remain entwined for several days. Females deposit up to 10 eggs in a crevice on the land. Only two nests have ever been discovered, so little is known about the how the hatchlings find their way to water. The lifespan of the banded sea krait is unknown. Conservation Status The IUCN classifies the banded sea krait as least concern. The species population is stable and the snake is abundant throughout its range. Significant threats to the snake include habitat destruction, coastal development, and light pollution. While the snake is a human food source, the threat from overharvesting is localized. Coral bleaching may impact the banded sea krait, as it may result in diminished prey abundance. Sources Guinea, Michael L.. Sea snakes of Fiji and Niue. In Gopalakrishnakone, Ponnampalam. Threat of New Entrants in the Mobile Phone Industry free essay sample

The mobile phone industry is already a well established market and the threat of a new entrant is quite low, as the technology needed to rival the devices already available is quite advance if they want to differentiate from them The barriers to entry in the mobile phone industry is high because any new entrants will need high investments in RD, technology and marketing in order to compete with the established organisations. New entrants want to take market share from the larger organisations but Nokia hold 29% of the market share in the industry, the highest market share in the industry. (BBC News, 2011) The threat of new entrants into the mobile phone industry is very unlikely as the start up cost of entering into the market at a high level needs a lot of investments and time to be considered a respectable competitor of the already established organisations. Nokia currently hold a 29% of the entire mobile phone market worldwide and for a new competitor to obtain some of their market will take either a very long term plan or something that is truly innovative and unseen before. We will write a custom essay sample on Threat of New Entrants in the Mobile Phone Industry or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page This is because realistically the new entrant will need very high investment for RD and marketing, and would not be able to publish positive result for a long time as they try to build a customer base and a name for itself in an established market. In conclusion the threat of new entrants is very low and not a factor which Nokia will have to worry about in the near future.

That Tally Stick Essay Example

That Tally Stick Essay Example That Tally Stick Paper That Tally Stick Paper So many people have keepsakes to symbolize their love for one another. Couples have pictures and mementos to remind them of their special times. In â€Å"The Tally Stick†, Jarold Ramsey introduces us to a couple who use a tally stick rather than pictures to represent what is important in their lives. Ramsey takes us from the beginning of the relationship, when the stick is bare, to the end when it is carved end to end. We learn of the outside events that build their love, as well as internal measure, upon which their love is built. According to Ramsey the stick is a part of the couple’s relationship. The tally stick shows that love can be a long-lasting bond defined by failure and success that strengthen their relationship. Before there is a single notch in the stick the narrator shows its significance. Ramsey indicates the stick is a gift, which represents the couple’s lifetime together. Saying, â€Å"From our first of days†¦/ I have carved our lives in secret on this stick† (1; 2). Their unique and extraordinary bond is directly represented by the type and length of the â€Å"Mountain mahogany† stick, Measured by â€Å"the length of your arms/ outstretched†¦Ã¢â‚¬ (3; 4). Also, because their relationship is so concrete and red with passion, Ramsey describes â€Å"the wood† as â€Å"clear red, so hard and rare† (4). In the opening stanza Ramsey shows that the tally stick embodies every part of this relationship, and its characteristics signify more than just important events. The first and most elaborate notch on the stick is the couple’s wedding. It is very detailed and enables them to relive their wedding. Like their lives â€Å"the grains /converge and join† (6; 7). The details of the notch are so specific the couple can tell â€Å"who danced, who made up the songs, who meant† them â€Å"joy† (9). The complex structures not only depict their wedding but the intricacy of their relationship, its specialness and how much they mean to each other. Inscriptions along the grain show the love they have for their children and how they want them involved in their lives’, indicated by â€Å"little arrowheads along the grain† (10). During times of grief the couple’s heavy hearts are exposed to the reader. Ramsey uses â€Å"heavy crosses† to mirror the couple’s mood during /â€Å"the deaths of† their â€Å"parents, the loss of our friends† (12; 13) Ramsey shows us that the difficult times made their onnection grow stronger. Death was not the only hardship they had to endure. Stanza three outlines all the external hardships the pair suffered through. Historic events were randomly cut against the grain, symbolizing occurrences that tried their relationship. â€Å"Hashmarks cut against the swirling grain† show how certain events could de stroy what they have (16). The poem indicates all the events their love survived, and shows their love has lasted many years. They remember what they thought was â€Å"the year the world went wrong† and â€Å"the days the Great Men fell† (17; 18). The third stanza ends with the power of the couples love, â€Å"The lengthening runes of our lives† that â€Å"run through it all† (19). This line from the poem signifies the strength their love possesses. There love persisted through hard times and their marriage grew stronger. These lines show that nothing compares to the love the two have for each other. Despite hardships their love continued to grow. In the final stanza the narrator talks about what it is like to look back on all the events that shaped the couple’s life. The stick is full of memories and represents a long lasting relationship. This relationship is made stronger by the events shown on the tally stick, every notch made them stronger and although the stick is beginning to wear, their love is not. â€Å"Our tally stick is whittled nearly end to end; delicate as scrimshaw, it would not bear you up† (20). Ramsey mentions that the stick is polished with regrets. Because they both have regrets that helped build their love, the couple clusters those regrets with all other mishaps â€Å"hand over hand† (22). The author ends the poem with the couple looking back on everything they have done. Running their fingers from beginning to end they will explore everything that shaped their relationship and forgive each other’s regrets. Ramsey refers to their blameless eyes, telling us that the two no longer blame one another and can go on loving through old age. Starting from when they were children, they follow the grain all the way to adulthood and â€Å"talk softly as of ordinary matters and in one another’s blameless eyes go blind† (27). The Tally Stick† is symbolic of everything this couple shares with each other. It not only shows special occasions like a picture but tells a detailed story of their life together. The couple relives the significant times they spent together by running their thumbs through the intricate notches. Detailed depictions of their wedding, the births of their children, the tragedies they have gone through can all be found within the stick. This stick defines the relationship, and is part of the each of them. The marks indicating internal events are the ones that remain special and are intricately drawn, where as the historic actions are just random marks, indicating they are not as exceptional as the internal dealings and everything random just fades away. â€Å"The Tally Stick† is a physical representation of this couple’s love for one another. It tells a practical story of the couple’s companionship, nothing on the stick is idealistic and depicts real events that drove their love, not what their relationship could have been, but what it is.

In Support of Designer Babies in China Essay Example | Topics and Well Written Essays - 750 words

In Support of Designer Babies in China - Essay Example This instance involved a shift in population policy away from Leninist family planning policy to softer neo-liberal methods, which involved indirect regulation by the state and self-regulation by citizens. Starting in 1956, the Ministry of Public Health oversaw a yearlong campaign for the use of birth control. However, these efforts portended minimal effects on fertility rates and the period following Great Leap Years saw a rapid population increase (Hesketh 12), which eventually necessitated the One Child Policy as a way to counter population growth. However, this policy has led ethical and moral dilemmas concerning gender and physical selection by parents who only have one try at parenthood. Out of the remaining alternatives for the Chinese government, genetic selection is the best choice to reduce control population, while solving the problem of sex-selection abortion and inherited diseases. One of the most visible effects of China’s One Child Policy is that parents have tur ned to sex-selected abortions in their search for boys, rather than girls. Various surveys carried out within China paint a grim situation with 117 boys born to every 100 girls because of sex selection abortions (Hesketh 62), while normal births resulted in a ratio of 105:100. Other surveys have found that Chinese women who migrated to Beijing in the last two decades arrived with only one hundred girls compared to one hundred and fifty nine boys. This shows that males are favored to girls in China, which has resulted in an increase of sex-selected abortions. However, by using genetic selection, parents would have the ability to choose the sex of their children prior to conception. This would result in a decrease of women influenced by the One Child policy to seek abortions and try again for a boy (Hesketh 63). Although this would not address the looming gender-imbalance in China, it will present women with a more harmless tool in determining the sex of their child. Genetic selection can also allow Chinese parents to have their only child with the characteristics they desire, which would reduce China’s growing population. With the largest growing population in the world, the government of China tried to institute regulations that sought to prevent further growth, causing controversy and general discontent about the laws (Orleans 44). The government and population would benefit from genetic selection in various ways with the government reducing population growth and the parents having their characteristic children. Parents who wish for children with specific heights, skill sets, athletic ability, and personal tendencies would be free to use genetic selection, rather than aborting their infants. Projection of the human genome could provide China and its people the ability to predict their future in terms of population growth and make-up (Orleans 45). Genetic selection will allow for screening out and in specific genes within the mother’s embryo, mak ing it possible to influence the natural characteristics of a child. Finally, gene selection could help China in reducing the number of unhealthy or disabled children. A recent study showed that there was minimal protest at the decision made, in the mid-2000s, to allow couples to test embryos for breast cancer genes and inherited bowel disease, which pushed humanity towards the creation of designer babies with healthy genes (Savulescu 39). Genetic selection will prevent the only child a family in China is allowed to have from having inherited disease. Some of the most common diseases among Chinese children are Down’s syndrome and cystic fibrosis and with genetic selection,

MPH522 - Public Health Law and Policy, Mod 4 Case Assignment Essay

MPH522 - Public Health Law and Policy, Mod 4 Case Assignment - Essay Example He did challenge this decision in several courts but lost and was ruled against by the Supreme Court (Barnes et al, 1993). We will attempt to show that this decision falls under the utilitarian ethics principle. Utilitarian ethics can be defined over all as a decision that is made as the best decision for the most people. The case is a utilitarian ethics case though it also has the element of paternalism which is deontoligic in nature. In this case, it could only be seen that they were making this decision for the greatest good because it was a decision that ruled against the single person and saw the law in the light of a bigger picture. The Supreme Court, in this case made a decision that did not agree with the single employee because it would have led to a loss of the ability to protect future employees from injury that they themselves may not protect themselves against. This is the way public health law works. The public, the law, as well as the courts have had some difficulty in determining what justice is when it comes to a case like this one (Kass, 2001). Does this also protect the company? The answer is of course yes. However, this again is a decision that is made for the largest nu mber, not for the individual. It does not feel right to us because we have a tendency to look for justice in the sense of the single human instead of the group. It is also so easy to see that the company is not only concerned about the employee but that this is a serious illness brewing and if allowed to continue will be a large burden on the resources of the company so in the end the decision is meant to protect the employee, the company and employees of the future. The second part of the Utilitarian principle is that the decision is extrinsic in its features and that the outcomes of the decision were extrinsic in nature. This is certainly true here. This decision will affect

Challenges to The Walt Disney Company

Challenges to The Walt Disney Company The Walt Disney Company Strategic Issues First Strategic Issue Walt Disney has experienced various strategic issues, and their strategic approaches have led to success. Its strategic management has identified the fact that their competitors could take advantage of the strategic weaknesses and pull the company behind in terms of market position. Although the issues are limited in such a successful company, they deserve maximum attention, as it is possible for them to act as threats towards the future welfare of the entire business. From a quick SWOT analysis, Disneys strengths are diversity and the surplus cash it attains from its business operations. Its weaknesses include the two strategic issues it is recently facing, its opportunities are expansion possibilities, and its threats include stiff competition. One of these strategic issues that Walt Disney has been facing is the loss of a good number of subscribers in the ESPN. Recently, the Entertainment and Sports Programming Network of Disney is holding fewer consumers as compared to the past years when the company began. The major reason leading to this shift of customers to other internet programs that offer similar services is the fact that watching sports with Disney has turned out to be more expensive as compared to watching the same sports in other internet platforms. Its historical market position, which was high at that time, had been attained through appealing to customers regarding prices. When it is specifically about sports, there are different ty pes of customers. Both adults and youths across the globe have high interests in sports. However, the youths appear to have more time to invest in the sports as compared to the time adults invest. Therefore, the larger portion of customers consists of young people, who in most cases are jobless or flexible in terms their jobs. It is a fact that with their flexibility regarding careers, the youth does not earn a lot of money, meaning they will always take advantage of companies that deliver services at the least cost possible. When Disney was affordable, it appealed to the two categories of customers successfully by ensuring that it is the most affordable platform in the world. However, when the internet-based competitors found a way of broadcasting sports at lower prices and others free, Disney did not pay attention to the matching of these standards. For this reason, it lost the youths mostly to other companies. Losing its portion of youths to the competitors is a great issue, whic h, were it not for other strengths that exist in the business, would have caused the downfall of Disney as an international company. Second Strategic Issue The second strategic challenge that Disney is facing in the presence of its competitors is vitality in the market. Disney is dealing with entertainment, which is all about the preferences and tastes of customers. This dealing is capable of easily leading to its downfall if the companys management does not focus on the strategic approaches of satisfying the customers thirst in terms of what they have a passion for but does not exist in the market. In case the product exists already, it is the duty of the company to modify it and make it more interesting to the customers without altering the likes but scraping the dislikes. With this sensitivity, Disney has faced criticism every time it has a new release in the market as much as it faces motivating response. Bearing in mind that the two types of responses are from customers that the company takes as a duty to please, making changes to attract a larger portion of motivating customers than critics has been an all-time operational goal th at may or may never be achieved. It becomes worse when during its evaluation, Disney realizes a loss of positive claims having turned to critics. This is always a clear message from the public that the company has made an unpleasant release and if they take it for a trend, their market position will be at stake. This is how hard it is for Disney to maintain a good market position having concentrated on the customers taste and preferences alone. Other factors such as the cost of services make the situation worse than it already is. These two strategic issues only need to be attended to with the right approach in order to make the companys future bright (Rukstad Collis, 2009). Alternative Causes of Action Reduced Quality To address the above strategic issues and realize the best course of action, it is important that attention is afforded to the nature of the issues. This can be achieved through a value chain analysis that helps to indicate the companys operational strategy and goals. The loss of Entertainment Sports Program Network subscribers must have been brought about by a faulty strategy in the organizations way of setting its standards. To solve this, the company can buy the cheaper systems adopted by competitors. When other internet service providers decided to engage in innovative ways of lowering their prices, the company did not embrace this idea, as it looked out for maintenance of quality. As a matter of fact, the internet services providers decided to adopt new and cheaper facilities that enhanced this reduction of prices to reach out to the customers whom in their opinion, watching sports had become expensive. While doing this, the first and most essential side effect they were likely to experience is the reduction of quality. Reduced Prices The company can as well alter their operations in a way to slightly reduce their prices and maintain quality at the same time. As much these services were to be availed to customers at a reduced cost, they were also to be displayed at lower qualities as compared to those displayed by Disney. In this case, the market of the ESPN was split into two. There is the lower quality of services available for those that prioritize the amount of money spent on entertainment, and the other sector of the market generates high quality of services for people who do not mind spending a fortune for the sake of quality. With this division, it means that Disney is not ready to compromise its quality of output in order to lower prices and accommodate more customers. This is how it ended up with a limited number of customers as compared to its competitors providing services through various internet platforms. Reducing prices with maintained quality will help to maintain the current customers and to bring back those that it lost to competitors. Stable Products Thirdly, the fact that Disney deals with mainly entertaining products is the main cause of the fact that it is faced with a strategic issue of dealing with customers tastes and preferences. In its market, Disney has a chance of securing its competitive advantage through dealing with motivational and educative films more than the entertaining movies. An educative product is easier to deal with in the sense that it will have nothing to do with the judgment of the customers, and the success will all depend on the effort of the company towards gathering as much knowledge in its products as possible. This way, it is possible to predict the responses of customers to its new releases. Additionally, these types of products will maintain the types of customers that the company is appealing to, bearing in mind that the youths would embrace guidance and the adults too will help respond positively to pieces of advice offered concerning their business and social lives. Just to make the point clea r, it is for a fact that Disney has invested partly in these sectors, but the entertainment has taken a better part of its products. This has not only subjected it to the risk of customers responses based on their personal tastes and interests but also on the parental force against time wastage. Their cartoon products, for instance, are found to be excessively attractive to the children to the extent that they fail to attend to other demands such as academic works. This creates a force between the cartoon products and parents as they push the children to balance all aspects of life. On the contrary, parents also utilize the products in making promises and rewarding children whenever they want them to engage in or maintain good conduct. An example is a case where the children are motivated to work harder and perform better in class in order to be allowed to watch cartoon during their holidays. All it needs to do is buy facilities that will accommodate this type of production. This wo uld make their output stable, predictable and more profiting. All the above alternatives can be implemented in Disney to stimulate its line of business (Rukstad Collis, 2009). Recommendations Evaluation The alternative of making strategic alterations to reduce the expenses of producing their products in order to lower the prices of their services is a possible approach for the ESPN issue. This will allow them to avail the same quality of services to customers at an affordable price. This means that they will be appealing to both the customers that value quality more than cost and those that are out there negotiating for lower prices. In this situation, they will have attained competition perfection in the sense that competitors that offer services at lower prices as Disney does will not be providing as high quality as that of Disney. On this note, Disney can be boosted by other secondary factors such as making sure that there is a constant flow of game displays throughout the season. This means that they will be displaying sports events even when the companies with the poor quality of facilities will be facing breakdowns for one reason or another. Disney will be the home for custome rs who are not ready for interrupted sessions while watching matches. However, if Disney decides to follow suit as its competitors and produce low-quality products, it will be faced with the con of losing customers who value quality. These qualities of attraction will not only help Disney to retain its current customers but also bring back the youth it has lost as potential customers. This way, the current position of the company in the market will be maintained, and the opportunity to expand will have been utilized to make Disneys future more promising. As its only con, Disney will experience an added cost of operating. This is why, on a personal level, I would recommend the alternative of making strategic alterations to reduce the expenses of producing their products in order to lower the prices of their services as an approach for the ESPN issue. If the cartoons and other entertainment films do not appear to be interesting to customers as the company expects it, there will be a d ecline of the income, as the customers will not purchase the product. The worst con of it is the fact that previews that are displayed before the release of the product may lead to customers shying away from the product early enough. The advantageous purpose of these previews is to help the company predict the performance of the product in the market before it is released. The response of customers may help to detect the problem awaiting the release of a new product, but it will not help in offering a solution for the problem. Therefore, although the company will avoid tampering with its good historic reputation, it will not have evaded losses as the product has already been produced, making this alternative not good enough. This is an indication that there is not short cut towards evading this instability other than engaging in more products that will promote positional security in the market. Hence, to curb the second strategic issue, I would recommend that Disney takes advantage of its stability in the market to seize the opportunity of expansion through dealing with the products that it has not dealt with before. Feasibility On the other hand, if Disney decides to embrace the cheap facilities like competitors have one to tamper with quality only for the sake of prices, they will end up losing customers that value quality, which is the major con of this alternative. Secondly, they will have performed below their operational standards of consistently maintaining the high quality of its products. The only advantage of this alternative is the fact that it will earn back its lost customers who value cheap products. The fact that the disadvantages exceed the advantages, in this case, makes this alternative not feasible. The alternative of displaying previews does not help to find solutions for the instability of products. This means that the act will not have delivered the major expectation, thus, making it not feasible. Implementation Disney should make plans to reduce the cost of running and lower the prices of their high-quality goods. This will help the company to reach out to the customers who do not watch Disney sports because of the high prices. Secondly, it should begin to take steps towards embracing other types of products in the market in order to attain stability. Since one of the strengths of Disney Company is that it always has a substantial flow of capital, this means it has the capability to indulge in the line of other products as heftily as it has done with entertainment. Therefore, all that Disneys management requires is to make decisions based on the expansion strategies that concentrate on this mission as an operational goal. Offering other genres of films and movies will allow the company to attain stability in terms of its market position. Attracting the entire market with motivational and educative products is easier than the entertainment form of attraction. References Rukstad, M. G. Collis, D. (2009). Structural Engineering Mishaps and Disasters :: essays research papers

Structural Engineering Mishaps and Disasters Hindenburg: An Unnecessary Disaster   Ã‚  Ã‚  Ã‚  Ã‚  In the 1930s airships, better known today as â€Å"blimps†, were the main source of air travel. During this time, the airships were used for various different reasons such as: bombing enemy targets, patrolling coastal areas, escorting naval ships during the night or through unsafe bodies of water, or used to make luxury flights across the Atlantic. The Hindenburg was believed to be the biggest and most sophisticated aircraft ever built.   Ã‚  Ã‚  Ã‚  Ã‚  The Hindenburg was built with metal framework and balloon like covering. It was as long as three football fields and weighed more than 240 tons. This airship looked ravishing, however, it possessed a significant flaw that eventually caused it to ruin. The outer skin of the Hindenburg was filled with hydrogen, which is extremely flammable. Passengers preparing to board the aircraft had to remove all lighters, matches, and/or any other objects that would cause it to catch fire.   Ã‚  Ã‚  Ã‚  Ã‚  Traveling all the way from Europe, the Hindenburg was expected to arrive in the United States and land in New Jersey on May 6, 1937. Max Pruss was commander, there were thirteen passengers, and twenty-two crew members on board . Hundreds of people waited for the Hindenburg, including: relatives of the passengers, news reporters, photographers, New Jersey citizens, and ninety-two ground crew members.   Ã‚  Ã‚  Ã‚  Ã‚  The flight’s landing was slightly delayed due to thunderstorms and aggressive winds. Finally, the weather calmed and the Hindenburg airship began to land in Jersey. One of the spectators noticed a pale pink glow in the lower center of the ship. Everyone began to become intense because they had a feeling that the glow was not suppose to be there. A few seconds later that section of the airship exploded! All the onlookers, of course, backed away rapidly, but were still close as the entire Hindenburg airship, and mostly all of its passengers caught fire.   Ã‚  Ã‚  Ã‚  Ã‚  Some parts of the Hindenburg did, in fact, remain together, but they are only preserved today for research. One of the passengers aboard the flight, a fourteen year old, climbed through a window trying to escape the fires of the airship. To his advance, one of the water tanks burst and the flames on his clothes and his body were extinguished.   Ã‚  Ã‚  Ã‚  Ã‚  The U.S Bureau of Air Commerce gave the following statement as an explanation of the explosion. â€Å"A small amount of explosive mixture (hydrogen) in the upper part of the ship could have been ignited by†¦{an} electric phenomenon like a ball of lightning.

Byzantine and the Impact of Islam

Byzantine is a Roman empire or the empire of Greeks in the Middle East. The history of Byzantine is a continuous line from the latter centuries of Rome to the very beginning of the modern time. It’s about the culture of the Greece and Rome that has a unique cultural history based on synthesis of Roman, European and Islamic elements when it suffered three crisis of external invasion, internal civil war and economy that later made the administrative center less important. (Bury, J. B. 1989).The emperor of Byzantine Empire was Justinian who occupied territories by the Goths and the main occupants of the empire were Christians, but after the fall of Rome; Christians who were horribly persecuted by the Byzantines welcomed the Muslims conquerors with open arms just to tolerate their religion. (Barker, J. W. 1966) By the time justinian resigned Byzantine was in a financial crisis. Later Heraculius succeeded him. When the throne was assumed, a forty-year old Arab named Muhammad swept the streets with messages of Islam across the entire empire. At the end of his regime Muhammad’s message came to pass and Muslims armies emerged and started making raids into Byzantine territory in Syria and began to conquer the Persian territories. (Bury, J. B. 1989) Because of the disaffected populations of Christians and Jews who had been persecuted earlier, the Muslim quickly conquered Byzantine territories in the ninth century. Their victory did not last long because of the Islamic government under Caliph deteriorated and Byzantines started to dominate the Asia Minor and by the tenth century they reconquered most of Syria and became more powerful and influential again. The crusaders The Byzantines however saught help from the Europe against the Muslims conquerors. Europe decided to assist them despite their cultural differences as they shared a common religion with the Byzantines. In 1204 the crusaders attacked the city of Constantinople a goal that the Muslims had been tr ying to conquer for centuries and conquered the Muslims. In 1261 the Byzantine Empire ceased to be an empire and was known as a small kingdom that later in 1453, the Constantinople city was permanently conquered by the Ottoman Turks and was renamed Istanbul.(Diehl, C. (1957) Byzantine Christianity Byzantine Christianity was a different religion from the Latin Christianity, what made it look different was the role of the emperor in matters regarding the faith. While for the Latin Christians the pope in matters of faith was almost solidified. Later the Byzantines inherited the roman idea and practiced a form of Christianity whereby theological authority was vested in the emperor. Through this theological authority it created a permanent breach in the world of Christianity between the west and the east. The breach was to produce iconoclastic controversy that the worship of images and icons was a sign of pagan belief. Only Christ and God should be worshiped this was angulated by Leo the saurian who had turned the tide against the Muslim in 717. The collapse of the Byzantine empire in 1453 saw the Russians believe that they were inheritors of the Byzantine empire and later began the roman empire. (Amis, R1995).Byzantium Empire and impact of IslamThe Byzantine Empire was able to survive for a period of time though not easily achieved through Heraculius some of the empires were kept together despite confrontation on the three sides of empire, and was able to save the empire from the Muslim. (Diehl, C. (1957) His effort worked but his 200,000 troops were killed and a lot of wealth lost during the war with the Persians. After the fight with the Persian he thought of rebuilding the empire but this was not to be as the empire was again attacked by another threat of Islam. The Muslims again got the opportunity to invade Persia and the Byzantine and this surprised both of them. The Persia and the Byzantine Empire did not have strength to fight back the Muslims attacks and th is paved way for Muslims to conquer the eastern provinces of the Byzantines. (Bury, J. B. 1989) The Muslims invasion in the empire weakened the internal division and many Christians wanted to keep their faith and always looked upon religious sects as heretics. Most of them who were persecuted to them life under Islam was good compared to Byzantines because Muslims did not look down upon other religion and this resulted to Muslims being welcomed to Byzantine Empire. Finally when Heraculius died the Muslim got opportunity to conquer the eastern provinces of Byzantine Empire. In the 14th and 15th centuries Islam was already being accepted by the Albanians and later it was in quick acceptance by other nations. . (Diehl, C. (1957) After the death of Mohammed Islam spread very fast and outside Arabia its spread was aided by various political upheavals. The long series of wars between the Byzantine and Persian empires is always credited for this fast spread in the near east especially after the triumph of the Muslims. The Byzantine Empire had the character of imposing Christianity on the population it conquered, for this reason the Syrians and the Egyptians resented and resisted the attempts made by the Byzantine Empire to impose Christianity on them. (Diehl, C 1957) Therefore when the Muslims came to these particular areas they were readily accepted to forestall any attempts that the Byzantine were trying to make, this led to the fall of Syria to the Arab armies to be followed soon by the fall of Iraq and Persia with Egypt falling in 640 AD with very little resistance. With this conquest Islam soon spread to most territories of the Near East and Africa. (Diehl, C. 1957) In the Byzantine Empire there was fierce fanaticism that included interdenominational strife and religious persecution amongst the Christians themselves, compared with the practice and the doctrine of the Islamic faith that tolerated other religions it endeared itself to others. For example the Byzantin es brutally attempted to suppress Christian sects who questioned the established Church. Also there was oppression of the peasants who were heavily taxed. The Empire also suppressed non-orthodox Christian teachings. Opposition to Islam after the conquest was weakened by the fact that under the Muslims, taxes were not very heavy like before and the non-orthodox Christian sects could now operate comfortably. (Diehl, C 1957) The spread of Islam in the better part of Middle East was made possible by Arab victories over Byzantine armies. The Byzantines were the major enemies to be encountered by the Aryans from the Arabian Desert. The encounter with the Byzantines was the first of many major battles between Muslims and Christians. It was Omar who acted as Caliph or head of the Moslem community in 634-44AD that initiated the fast expansion of the Arabs and Islam. Omar achieved the first great successes of Arab armies outside of the Arabian Peninsula when he conquered the Byzantine Empire ru led by the Emperor Heraclius. Omar's armies attacked Syria, seizing large areas. In 636AD at the Battle of Yarmuk the Byzantine Army were greatly humiliated by the Arabs when they defeated them. This saw the Arabs entering Jerusalem and Damascus in 638. It was during these period that it is believed Christianity replaced Christianity in this particular area as a result of the weakness of the Byzantine Empire. Arab rulers imposed a personal tax on all non-Muslims, which encouraged many to convert to the Muslim Faith. In the new Caliphate there was no forced conversions but happened later. At first the Arabs did not consider converting anyone because of the taxes they collected which provided great incomes.(Diehl, C 1957) Cultural and intellectual factor Islam as a religion does not recognize superstitions but is a simple and rational religion that emphasize on knowledge and learning. Through learning as the foremost priority to humankind the Islamic civilization spread through many co untries. The Muslim never destroyed things in middle east as the Christians in Spain what they did was to defend what was positive and eventually embrace it.Political and economic impactIslam was seen as a religion without any political and economic principles. However Islam preached a new concept of human relations avoiding nationalism and class divisions. Islam main concern and interest was humankind’s relations with God. Politically Islam perception was that the supreme power rests with God and equality before the law is a major principle of the political system. (Diehl, C. (1957) In Balkan nations, emergence of Islam was very important compared to the Byzantines Empire.Islam also emphasized on the economic aspect of life and this was clearly shown through justified ways of making profits, possession of property and not overspending and everybody must earn a living in an honest way. Islam came up with obligatory and voluntary laws that have played important roles in the ec onomic system of Islam. Before Islam spread to Balkan nation and Byzantine Empire people who lived there had some kind of social chaos but Muslims brought a new approach to the social lives of the Balkans. For example: Muslim women played a crucial part in the institution of family and were always considered equal in every aspect to her male counterpart. A woman is always the first to show kindness, love, and sincerity and educate. While for Christians, women are seen as devils instrument to harm or hurt people. (Diehl, C. (1957) When they conquered Byzantine Islam played a role in regulating the slavery and sanctioned better conditions for the slaves and even encouraged the prohibition of slavery.Islam also brought together the Middle East and came up with a common language known as Arabic and a common religion known as Islam. After all this positive impact of Islam in Byzantine Empire some of the rules set up are not applicable in the 21st century. At one time there were most power ful, rich and advanced people and today they have created four empires, which include Umayyad, Abbasid, Mogul and Ottoman Empire. Their decline can be traced to about 1700 when the west caught up with the Ottoman the great Muslim empire and started misinterpreting the Koran.(Amin, H. Cohabitation – Blessing or Destroy the Relationship

Cohabitation – Blessing or Destroy the relationship? One of the most dramatic trends of recent years has been the tremendous increase in male-female couples who choose to live together without marrying, a practice called cohabitation. According to the 2000 Census, there are eleven million unmarried people living with an unmarried partner in the United States today, and this number has grown 72% in the last decade alone.
